How Colorado Divorce Proceedings Work
To start a divorce case in Colorado, one spouse must complete and file a Petition for Dissolution of Marriage (Petition) with the family court located in the county in which (s)he lives. There are different forms for divorce cases that do and do not involve children, and all divorce-related court forms can be found here.
Once the proper paperwork has been submitted to the court (with the required filing fees):
- The petitioner (i.e., the spouse that filed the initial Petition) will be responsible for serving the other spouse a copy of the divorce Petition.
- The other spouse (i.e., the respondent) will have anywhere from 21 to 35 days to file a response to the Petition (with 21 days being for respondents in Colorado and 35 days being for respondents outside the state).
- If the respondent agrees to the terms and details in the Petition, the divorce can proceed as an uncontested case. These divorce cases can be resolved as soon as 91 days after the Petition has been filed. If the respondent disagrees with any terms in the Petition, the divorce will proceed as a contested case.
Contested divorce cases can move forward in a variety of ways, depending on the circumstances involved. Generally, however, contested divorce cases will advance via proceedings like (but not necessarily limited to) an initial conference, a status conference, mediation and a permanent orders hearing.
The permanent orders hearing is the proceeding during which the divorce will be finalized. During this hearing, the court will enter final orders regarding matters like:
- Property division, including the distribution of the marital assets and debts
- Child custody, including parenting time and parental decision making responsibilities
- Support payments, including spousal maintenance and/or child support.
The division of marital assets and martial debts, collectively known as the ‘marital property,’ is commonly a point of dispute in divorces cases. In fact, divorce property disputes can involve fights over issues like (but not necessarily limited to):
- Whether assets and debts constitute separate or marital property
- Allegations of hidden assets
- How marital property should be fairly divided between divorcing spouses.
